Judge William H. Seals, Jr. issues orders regarding Hospitality Fee inside the City of Myrtle Beach

Please note the following items as a result of an order by Judge William H. Seals, Jr.

  • Horry County remains enjoined from collecting Hospitality Fee inside the City of Myrtle Beach

  • City of Myrtle Beach Local Accommodations and Hospitality Taxes remain in effect

  • City will mediate dispute with Horry County

Pursuant to the South Carolina Circuit Court’s Order of July 17, 2019, Horry County remains enjoined from collecting its 1.5% uniform service charge within the city’s corporate limits.  A copy of the court’s order is available at https://www.cityofmyrtlebeach.com/2019-07-17%20Order%20on%20Motion%20for%20Stay%20or%20Supersedeas.pdf.  

The City of Myrtle Beach will continue to charge its Local Accommodations Tax, Hospitality Tax and Hospitality Fee as outlined in the chart below, which was first published on the city’s website on June 25, 2019.  See https://www.cityofmyrtlebeach.com/news_detail_T6_R550.php

The court has also ordered the city and county to participate in a mediation of their dispute regarding the county’s 1.5% uniform service charge and the city’s Local Accommodations Tax and Hospitality Tax beginning no later than August 1, 2019.  Florence attorney Karl Folkens has been appointed by the court to serve as the mediator in this matter. 

The city is prepared to participate in the ordered mediation in good faith and looks forward to an opportunity to discuss a possible resolution of its dispute with the county in a confidential setting, which discussion may include matters raised by the county in its April 2, 2019, Resolution 36-19, proposing a settlement.
